Eligibility to use the Services

To register with and shop on shop.godrejsecure.com, you must be eighteen (18) years of age or older and be able to understand and agree to the terms, conditions, obligations, representations, and warranties set forth under these Terms. If you are a minor i.e., under the age of 18 years, you may use shop.godrejsecure.com only with the involvement of a parent or guardian.

Provision of the Services

i.            You acknowledge and agree that the form and nature of the Site, may require affecting certain changes in it, therefore, may change from time to time. Accordingly, we reserve the right to suspend the Site, or cancel, or discontinue any or all products or services at any time without notice, and to make modifications and alterations to any or all of its contents, products and services without prior notice.

At the time of your registration, you will receive a password. Please keep it secret and protected, as you are entirely responsible for maintaining the confidentiality of your password. You are responsible for all orders placed with us or information given to us under your e-mail address or mobile together with your password. You must immediately notify us of any unauthorized use of your e-mail address and/or password, or any breach of security known to you.

All telephone calls made to and from our Customer Service team may be recorded and monitored. These recordings are undertaken for purposes of quality assurance, training, compliance, and dispute resolution. By continuing with the call, you consent to such recording and monitoring. Limitations of Damages

We will not be deemed to be in breach of contract or of these Terms as a result of any delay in our performance or failure to perform our obligations if that delay or failure is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood, acts of God, epidemic, pandemic, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.

In any event, our maximum liability arising out of any order for the supply of products to you under these Terms will be limited to the retail price of the products contained in that specific order.

Neither we nor any of our subsidiaries, affiliates shall be liable to any entity for any indirect, special, consequential or other damages related to the use of, or the inability to use, the content, materials, and functions of the Site and/or any linked website.

Indemnity and Release

You shall indemnify and hold us harmless from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any document incorporated by reference, or your violation of any law, rules, regulations or the rights of a third party.

Changes

We reserve the right, to change, modify, add or remove any portion of these Terms. Changes to these Terms will be effective when notice of such change is posted. Your continued use of the Site after any changes in these Terms have been posted, will be considered acceptance of those changes.

Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. You agree, as we do, to submit to the exclusive jurisdiction of the courts at Mumbai.

Any cause of action you may have with respect to your use of the Site must be commenced within one (1) year after the claim or cause of action arises.

ORDER PLACEMENT, PRICING AND OTHER TERMS

1.      Order

1.1   All use and purchases made on this Site are governed by these Terms. Although the Terms governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order products after we have published any changes you will be bound by those changes.

Accordingly, you should check prior to each use or order to ensure that you understand the precise Terms applicable to your Site visit or purchase.

1.2 We sell products only to end-users.

1.3   When you place an order through the Site, we will acknowledge receipt by displaying a confirmation message on the Site and by sending a confirmation to the e-mail address or mobile number you have provided. Please note that this confirmation is only an acknowledgment that we have received your order and does not constitute acceptance. Subject to our cancellation rights, acceptance of your order and completion of the order will occur only when we dispatch the products to you.

1.4 We reserve the right to cancel any order prior to dispatch for any reason, including but not limited to stock unavailability, pricing errors, or verification requirements.

1.5  Before placing an order, you are advised to check the product description carefully. By placing an order for a product, you agree to be bound by the conditions of sale included in the item's description.

2.      Product Pricing

2.1 The prices stated on the Site will be inclusive of any GST payable.

2.2  Each order you make may include a delivery charge. Delivery charges may vary depending on several factors, including but not limited to:

·         The delivery location and distance

·         The floor of delivery (for example, apartments without lift access)

·         The size and weight of the Product

·         Additional labor required for handling or installation

In certain cases, extra charges may apply if delivery involves special arrangements, such as carrying heavy items upstairs or delivering them to remote areas. For heavy weighted skus, below are the shipment charges:

3.       Payment Options

3.1  Payment must be made via debit card, credit card, internet banking or approved digital wallets. Cash or cheque payments are not accepted

3.2 The debit, credit and charge cards accepted by us are those listed on the Site at the time you place your order.

3.3  If you select an EMI or No-cost EMI option, such financing may involve some processing fees or interest charges. This arrangement constitutes a separate contract between you and the relevant service provider, entered into at your sole discretion. We act only as a mere facilitator and are not party to such contract.

3.4  Default in Payment-If payment is not received or is declined by your card issuer, bank, or wallet provider, we reserve the right to cancel your order. We are not responsible for any costs, losses, or damages resulting from such cancellation. Title to the products will not pass to you until full payment has been received by us.

4.      Shipment of Products

4.1  Delivery days and times will be as specified on the cart page of the Site and will be made to the address provided by you when placing an order through the Site. We reserve the right to restrict deliveries in certain areas and including the right to exclude certain areas from our delivery schedule altogether.

4.2  Products are subject to availability and prevailing market conditions. We may limit the quantities of products (particularly products on special offer) supplied to any one customer if we believe the quantity ordered jeopardizes availability for other customers.

4.3   We will endeavour to supply you with the full quantity and accurate products that you have ordered. In any event, our liability will be limited to the price of the products not delivered or incorrectly delivered and the applicable charges of delivery and we shall not be liable for any indirect or consequential losses.

4.4  We take special care to ensure that deliveries are made on time, it is your responsibility to ensure that an appropriate person is available at the delivery address during the delivery day. We may require an appropriate person to sign for the products upon delivery.

4.5   Please note adverse weather conditions or other events outside of our reasonable control may result in occasional late delivery. If this occurs, we will endeavour to contact you as promptly to reschedule your delivery time and date. In any event, our liability will be limited to a refund of the price of products not delivered and the applicable charges of delivery.

4.6  Should you fail to be present for your delivery (or if the wrong address is provided) we are entitled to charge you in full for the price of the products and applicable delivery charges.

4.7 The confirmation e-mail you receive from us, will specify the last time you may amend your order prior to delivery.

4.8  You can change the address you have registered on the Site through the 'Address Change' feature. However, this will not apply to any orders for which you have already received a confirmation e-mail.

5.       Out of Stock Situations

Our endeavour is to ensure that all products listed on the Site are available for dispatch to you. However, in case a product is not available for any reason, we will contact you and provide the option to exchange, delay or cancel the order at your discretion.

6.      Warranty

6.1  Scope of Warranty

·         Eligibility: This warranty is extended only to the customer purchasing the Product from an authorized platform, dealer or reseller of the Company. It is non-transferable and cannot be claimed by any subsequent buyer.

·         Product(s): All models of Home Lockers manufactured, imported, marketed and sold by the Company, either directly or through its authorized dealers/ resellers including authorized online resellers.

·         Customer: An end-user (a person, firm, company or a legal entity) that purchases the Product(s) from the Company or its authorized dealers/ authorized resellers/ authorized online resellers.

·         Geographic Coverage: This warranty is applicable to Products sold and used within India only.

·         Hardware Defect Coverage: The warranty covers manufacturing defects in the hardware of the Product only. The Company's obligation is limited to repair or replacement (at its sole discretion), subject to hardware availability. The Company's decision on the nature of the defect shall be final and binding. In case damage is observed in a supplied or in-use Product, the Company shall hold the final right to decide the applicability of the warranty terms, including the decision to repair/ replace the relevant part of the Product based on the report submitted by the Company's service representative.

·         Software Exclusion: No warranty is offered for software, whether pre-installed, updated, or installed separately by the Customer. Use of software is governed by the relevant software provider's End User License Agreement (EULA) made available with the software. All rights, title or interest in respect of the intellectual property rights relating to software will always remain with the respective licensor of the software at all times.

·         Proper Use Required: The warranty will be void if the Product is not used in accordance with the user manual or manufacturer's instructions issued by the Company.

·         Policy Updates: The Company reserves the right to revise warranty terms from time to time. Customers are advised to check the policy on the website. Changes to the policy will not affect warranty claims for Products purchased before the policy revision date.

6.2 Warranty Duration

·         Period of Warranty: Godrej Security Solution products on https://shop.godrejsecure.com/ are offered with a standard warranty (Warranty) of one year, plus a 6 month additional warranty from the date of purchase (Warranty Period) by the original purchaser against manufacturing defects until and unless specifically mentioned. All the warranty clauses mentioned will be applicable for 6 month extended warranty period.

·         Commencement of Warranty: The warranty period begins from the Customer's date of purchase of the Product mentioned on the original Tax invoice.

·         The Warranty Period on the replaced or repaired Product shall be reduced to the balance period, as computed from the date of first sale of the Product. Spares replaced on a chargeable basis will carry a warranty for three months from the date of replacement, whereas for spares replaced FOC, the warranty ceases with the original warranty period of the full Product.

6.3  Warranty Exclusions

This warranty shall not apply to the following:

•                  Products purchased from unauthorized sellers.

•                  Consumables such as batteries, plastic parts, and accessories (unless defective within 15 days of purchase).

•                  Physical or cosmetic damage during transit or use.

•                  Use with third-party products, third party software or data, user installed software accessories.

•                  Loss of override key(s)/mechanical key(s) by the user that includes keeping the override key(s)/mechanical key(s) inside the Home Locker or Fire resistant safe.

•                  Damage due to accidents, misuse, natural disasters, rodents/insects, or exposure to abnormal voltage.

•                  Unauthorized modifications.

•                  Firmware/software installations. Password forgotten cases for Home Lockers.

•                  Operating or storage conditions outside the recommended guidelines.

•                  Normal wear and tear.

•                  Removal, alteration, or tampering of serial numbers or labels.

•                  Loss, theft, or lack of proof of purchase.

•                  Service by unauthorized personnel.

•                  Issues related to signal reception or compatibility.

•                  Voltage variation is beyond 5% of rated voltage.

6.4  Warranty Service Procedure

·         After evaluation, an authorized representative will call back to determine warranty eligibility.

·         Dead on Arrival (DOA): If the Product is DOA, Customers must report it within 3 days from the date of purchase for replacement to the original Seller.

·         Proof of Defect: Customers may be required to submit photographic and/or video evidence or make the product available for inspection.

·         Repair or Replacement: The Company may, at its sole discretion, choose to repair the defective part, replace it with a refurbished or a new equivalent Product. All replaced products/parts become Company property.

·         Turnaround Time: While we aim to resolve issues promptly, no guaranteed turnaround time is provided.

·         Cosmetic Variations: Replaced parts may differ slightly in shade, pattern, or size.

·         Out-of-Warranty Service: Out-of-warranty service is available on a chargeable basis. An estimate will be provided in advance.

·         Data Responsibility: Customers are advised to back up all data before service. The Company is not responsible for any data loss.

6.5     Warranty Disclaimer & Limitations

·         Company makes no other express warranty either in writing or otherwise and expressly disclaims all warranties and conditions not stated in this warranty. Company does not warrant that the operation of the Product(s) will be uninterrupted or error-free. To the extent allowed by the Indian laws, the Company disclaims all implied warranties or conditions, including any implied warranties or conditions of merchantability, merchantable quality, and fitness for a particular purpose.

·         Except as indicated above, in no event shall Company be liable for:

a)      any indirect loss or damage arising out of or resulting from the purchase, use or improper functioning of the Product(s), including but not limited to lost profits or savings, business interruption, business loss, loss of data, lost revenue, loss of use, or any other commercial or economic loss of any kind, or any special, incidental, or consequential damages/loss.

b)     Any claim made by a third party or made by Customer on behalf of a third party.

·         The Company's liability to the Customer under this warranty is limited to the price of the Product.

·         Warranty does not extend or restart post repair/replacement; it continues as per the original purchase date.

·         Unauthorized repair voids the warranty.

·         In case of disputes, the decision of authorized Company personnel is final.

6.6  Warranty Jurisdiction

All disputes arising under or related to this Warranty Policy shall be subject to the exclusive jurisdiction of competent courts in Mumbai, Maharashtra, notwithstanding that the Products may have been sold or delivered elsewhere.

7.       Cancellation Policy

A.  Cancellations by Company

·         We reserve the right to cancel any Order or any distinct item within an Order at our sole discretion, including but not limited to cases of product unavailability, pricing or listing errors, or logistical challenges

·         In such cases, you will be notified promptly, and any amount paid will be refunded via the original mode of payment.

·         We shall not be liable for any additional costs, losses, or obligations arising from such cancellation.

B.      Cancellations by Customer (Before Delivery)

·         Orders cancelled before the Product is delivered will incur a processing fee of 10% of the total order value.

·         The balance amount will be refunded via the original mode of payment within 15 business days of cancellation confirmation.

C.      Cancellations by Customer (After Dispatch or Delivery)

·         Orders cannot be cancelled once the Product has been dispatched or delivered. Orders cancelled after dispatch or delivery will attract a cancellation charge of approximately 10% of the order value, which may vary depending on the shipping and logistics costs actually incurred by us.

·         The balance amount will be refunded via the original mode of payment within 15 business days of cancellation confirmation.

·         Customers remain eligible for returns or replacements in case of defective, damaged, or incorrect products, as per our Return & Replacement Policy.

8.      Return and Replacement policy

8.1  What's eligible for Replacement?

·         Damaged or Missing Components- For any concerns regarding damaged incomplete products", or missing components, such claims are to be highlighted at the time of delivery/assembly or within 3 days from the date of purchase (whichever is applicable).

·         Defective Products- If the item delivered to you is found to be defective, full replacement will be offered post validation by our service team. Please note that natural variations in material like appearance or texture are not considered defects.

·         Incorrect item - If the Product delivered to you differs in dimension, shape, specification) from the Product ordered on the Site.

·         Return Subject to Cost Recovery: In certain cases, returns may be accepted subject to a return handling cost, which will vary depending on the expenses incurred by us in delivering the Product to you.

8.2 What's NOT eligible Replacement?

·         Once return window is closed – we will not be able to accept return requests.

·         Change of Mind will not be accepted for return request.

·         Product Color May Slightly Vary Due to Photographic Lighting Sources or Your Monitor Settings. Such variations will not qualify for return. Relocation - After an item has been delivered to you in perfect condition, in the event of the subsequent dismantling of the item for relocation, reassembly," etc please note that Security Solutions team will not be responsible for any damage to the product.

·         Certain products such as accessories might not be eligible for 7 days replacement.

·         Sale items, gift items, custom orders, or products with tampered/missing serial numbers.

8.3  Product returns

·         We advise that you inspect the products promptly at the time of delivery and notify us of any defects immediately. If you discover a product is faulty", please call our Customer Service team on 080-6743-6743 as soon as possible or email us at secare@godrej.com for best possible action to resolve the issue.

·         To return any items that are damaged or not as per your original order, please return to the delivery person or inform our customer care within 3 days from the time of the product delivery. Please check the terms and conditions of each product you order to confirm its cancellation policy.

·         All damaged items or items not as per your order that are to be returned must be accompanied by a copy of the original receipt and be in the same condition as delivered, with original packaging, tags, manuals, and accessories intact.

·         Please note that we cannot offer replacements, returns or refunds of any opened or used products.

·         Refunds will be processed within 15 business days from the date we receive the returned Product. You will be notified once the return is complete.

·         Refunds will be issued only to the original payment method used at the time of purchase. No cash refunds will be provided.

9.      Liability Limitation

Our responsibility under this Return and Replacement Policy is limited strictly to repair, replacement, or refund of the product price and applicable delivery charges, as determined by us. We shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profits, business interruption, or loss of data, arising from or related to product returns or replacements.

10.   Fraud and Misuse Protection

We strive to provide the utmost protection to our Customers against any fraudulent activities. However, if a Customer is found to misuse this Cancellation, Return & Replacement Policy, including but not limited to, excessive cancellations, repeated returns, refusal to accept confirmed orders, or any other abusive activity, we reserve the right to take appropriate action in such cases.
